Terms of Service

These Terms of Service constitute a legally binding agreement between you and iQuality Tech INC. (dba NylaLand), Canada. They apply to all NylaLand services including our website (nylaland.com), digital scratch card platform, and purchases made through our Etsy shop. By using any NylaLand service you agree to these terms.
Acceptable Use
You may use NylaLand to create and share personalised digital scratch cards for personal, gift-giving, and non-commercial purposes. You must not use our service to create content that is illegal, offensive, harassing, defamatory, or that infringes on any third-party rights. We reserve the right to remove any content and suspend access for violations of these terms.
User Content
You are solely responsible for any text, images, and messages you upload or enter when personalising your scratch card. By using the service you confirm that:
- You own or have the legal right to use all content you upload
- Your content does not infringe any third-party intellectual property rights
- Your content does not contain illegal, offensive, or harmful material
NylaLand does not actively monitor user-submitted content but reserves the right to remove any content that violates these terms.
Proprietary Assets
All background designs, animations, audio, and card templates provided within the NylaLand platform are the property of iQuality Tech INC. or their respective licensors. These assets are licensed for use exclusively within the NylaLand service. You may not extract, download, redistribute, or use these assets for any purpose outside of NylaLand.
Intellectual Property
The NylaLand name, logo, website design, and platform are the property of iQuality Tech INC. All rights reserved. You may not reproduce, copy, or imitate any part of our brand or platform without written permission.
Service Limitations
NylaLand provides temporary hosting for your scratch cards. Builder links and viewer links expire 30 days after creation. All personal card content (custom text and uploaded photos) is permanently deleted after expiry. It is your responsibility to share or use your link within this timeframe. We are not responsible for expired or inaccessible links.
NylaLand scratch cards are digital products delivered via unique links. Each purchase provides one unique link. Sharing your link with others is permitted — reselling, redistributing, or commercial use of purchased links is strictly prohibited.
Payments & Billing
All purchases are processed by Polar Software Inc., acting as the Merchant of Record. By completing a purchase, you acknowledge that the transaction is governed by Polar's Terms of Service and Privacy Policy. Polar is responsible for the collection and remittance of applicable global sales taxes on these transactions.
Refunds
As our products are digital and delivered immediately upon purchase, all sales are generally final. If you experience a technical issue that prevents you from accessing your card, please contact us at hello@nylaland.com within 7 days of purchase and we will resolve it. Disclaimer
NylaLand is provided “as is” without warranties of any kind. We are not liable for any issues arising from the loss of data after the 30-day expiration, technical downtime, the misuse of shared links, or any indirect or consequential damages arising from your use of the service.
Changes to These Terms
We may update these terms from time to time. Continued use of NylaLand after changes are posted constitutes acceptance of the updated terms. The date at the top of this page indicates when the terms were last revised.
Governing Law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario, Canada.
